UPDATE: SUPREME COURT REJECTS THE IDEA OF DEATH FOR RAPE OF A CHILD:
WASHINGTON - Proponents and opponents of imposing the death penalty for rape of a child underwent intense questioning Wednesday from a seemingly divided Supreme Court.
The hour-long argument came in the case of inmate Patrick Kennedy, sentenced to death for raping his 8-year-old stepdaughter.
Kennedy's lawyer, Jeffrey L. Fisher, told the court the death penalty for child rape under Louisiana law violates the Eighth Amendment protection against cruel and unusual punishment.

(A thethinkingblue personal opinion) When Gore lost the ability to have a recount in 2000 and the Supreme Court awarded the presidency to George W Bush, I knew exactly what was going to happen within this holiest of Courts. I knew, the great headway that was made to lessen human suffering would probably be overturned and that future supreme decisions would be handled by the judges, W. Bush would get to nominate to give the conservative ideology a court majority. It seems this de ja vu I felt was right on target. It didn't take a rocket scientist to figure it out! The republican party has for 50 years had this as their goal. But I wished the hell I knew why?

This is beyond idiotic.
The Supreme Court has a 4-5 split on ideology, but it is not the "right" that dominates it. Ginsburg, Souter, Stevens, Kennedy, and Breyer are all left of center. Kennedy is the closest among them to being in any way moderate. Scalia, Thomas, Alito, and Roberts are in the minority. Those who want to read the Constitution as being LAW, not just suggestion, are in the minority! The Constitution is supposed to be the final word, not some arbitrary standard of "Fairness."

Quite right. It really scares me. Not only do liberals find it necessary to protect a child rapist from the needle, but they also seem to have no grasp on what really went down in this case. Look at the evidence because theres a HELL of a lot more than just the girl's testimony that convicted the guy...the story the stepfather told was full of holes, he waited over an hour to call the police, he called someone right after for advice on how to clean up the bloodstains, it just goes on...

As far as the arguments that it actually hurts the children to have death for child rape, if THAT is the reason you oppose the death penalty in this case, fine...I have NO problem with that. But too many people seem to believe executing a man who rapes a little girl is actually cruel...read a description of the girl's injuries and then try saying he doesn't deserve to die. Hell, your liberal messiah Barrack Obama even disagreed with the court on this case. COME ON!

Most of those bitching about this "man" being on death row have no idea what they're talking about. I do. I know this case inside out...one of my good friends is one of the policemen who was at the scene when the rape was called in...he remembers very clearly how much damage was done to the child...it fucks with him to this day...imagine how the girl feels.

The biggest problem with execution is that it is the best cover of the frame up. If you frame someone and they are executed, your done. You just got completely away with it. You can be sure nobody will be coming after you now, because there is little to gain from new discovery.

This is true kangalantolian, and is one of the reasons I used to oppose the death penalty: risk of executing an innocent person. My rant wasn't directed at people who oppose the death penalty as such. It's just that this episode was based off a real case in which people came up with some preposterous arguments as to why not to execute the guy (there ARE valid reasons to forego execution and you and DoctorScrumpy pointed two of them out...although I ultimately disagree, those are sound points)

In the Kennedy case (on which this case is based) people tried saying the guy was retarded (when his actions showed a clear and logical state of mind), that racism factored into his case (I hate even dignifying that with a response...the little girl was black too), that evidence was inconclusive as to his guilt (read the case file...the evidence is pretty overwhelming), and that child rape somehow isn't a bad enough crime (honestly, it takes a darker heart to rape a child than to take a life)
